Land Sale and Conservation Easement - San Saba County
Colorado Bend State Park

I. Executive Summary: Texas Parks and Wildlife Department (TPWD) is in negotiations with a private landowner for a land sale at Colorado Bend Sate Park.

II. Discussion: TPWD has been contacted by an adjacent landowner requesting to purchase an approximate 12.5 acre tract of land (Tract), in part of Colorado Bend State Park (Park). The landowner currently has permitted right-of-way access to his property from TPWD across the Tract.

The landowner has proposed to purchase the property for appraised value with TPWD placing a conservation easement on the Tract. In addition the landowner will donate a conservation easement on a portion of the landowner's property that is adjacent to the Park. The conservation easement is a strip of land approximately 750' wide by 1.7 miles long containing approximately 144 acres of land.

III. Recommendation: The staff recommends the Texas Parks and Wildlife Commission adopt the following motion:

"The Texas Parks and Wildlife Commission adopts by Resolution in Exhibit A, the provisions of this land sale and conservation easement at Colorado Bend State Park."

A Resolution by the Texas Parks and Wildlife Commission Regarding the Sale of a 12.5 Acre Tract of Real Property at Colorado Bend State Park, San Saba County and Acceptance of a Conservation Easement on Adjacent Property

Resolution

Whereas, Texas Parks and Wildlife Department (TPWD) staff have recommended that the Texas Parks and Wildlife Commission (Commission) approve a transaction to sell a 12.5 acre tract (the Tract) at Colorado Bend State Park (the Park) to an adjacent landowner at appraised value, but retain a conservation easement on the tract;

Whereas, the Tract was used as a dump site by the previous owner and provides little or no recreational or natural resource value to the Park;

Whereas, TPWD staff have also recommended that the Commission approve the acceptance of the donation of a conservation easement on a strip of the adjacent landowner's property measuring approximately 750 feet by 1.7 miles, totaling approximately 144 acres, to be finalized simultaneously with the sale of the Tract;

Whereas, the recommended conservation easement will prevent any significant development and thus protect this view shed at Colorado Bend State Park;

Whereas, the Commission finds, in accordance with Chapter 26 and Section 13.009 of the Texas Parks and Wildlife Code that (1) ownership of the Tract is no longer in the best interest TPWD; (2) there is no reasonable and prudent alternative to the sale of the tract; and (3) the sale of the Tract, while retaining a conservation easement, includes all reasonable planning to minimize harm to the Tract.

Now, therefore, the Texas Parks and Wildlife Commission authorizes the Executive Director to take all necessary steps to sell the Tract for appraised value to the adjacent landowner and accept the donation of a conservation easement from the adjacent landowner.
