Utility Easement - Polk County
Lake Livingston State Park

I. Executive Summary: Sam Houston Electric Cooperative requests an easement across Lake Livingston State Park to replace an existing electric utility corridor.

II. Discussion: 636-acre Lake Livingston State Park was acquired in 1972 and opened to the public in 1977. Electrical service is provided to the park by Sam Houston Electric Coop. The Coop needs to upgrade a distribution line for the area, and has indicated it is not feasible to replace it in its current location. The Coop requests the lease of a 20-foot wide corridor from Texas Parks and Wildlife Department (TPWD) running along a public road on the northwest boundary of the park for a distance of 49.2 rods (812 feet). Natural and cultural resource staff has worked with the Coop to evaluate and clear the proposed route. The line is routed so as to minimize impacts to park operations, aesthetics and park visitors. Fees and rates would be applied in accordance with standard TPWD schedules.

III. Recommendation: The staff recommends the Texas Parks and Wildlife Commission adopt the following motion:

"The Executive Director is authorized to negotiate terms and conditions under which an easement may be granted, and to grant an easement, to Sam Houston Electric Cooperative for the construction of overhead electric service lines across Lake Livingston State Park."
