Fee Rules - License Fee Corrections

I. Executive Summary: This item seeks adoption of proposed regulations that would correct inaccurate fee amounts. The proposed rules:

II. Discussion: The Texas Parks and Wildlife Commission at its May 2009 meeting adopted a range of fee increases affecting recreational and commercial licenses. The marine dealer, distributor and manufacturer's license was inadvertently included in the increase but should not have been. The fee for the marine dealer, distributor and manufacturer's license ($500) is prescribed by Parks and Wildlife Code, §31.041, and cannot be increased by Commission action. In March 2009, the Commission adopted provisions to implement the paddle-craft all-water fishing guide license; however, the fee was not adopted at that time and was inadvertently excluded from the May 2009 fee item.

Staff received permission at the August, 2009, meeting of the Regulations Committee to publish the proposed amendments in the Texas Register for public comment. The proposed regulations (located at Exhibit A) appeared in the October 2, 2009, issue of the Texas Register (34 TexReg 6831). Staff has gathered and analyzed public comment pertaining to the proposed amendments and a summary will be available at the time of the meeting.

III. Recommendation: Staff recommends that the Texas Parks and Wildlife Commission adopt the following motion:

"The Texas Parks and Wildlife Commission adopts amendments to 31 TAC §§53.13 and 53.16, concerning Fees, with changes as necessary to the proposed text (located at Exhibit A) as published in the October 2, 2009, issue of the Texas Register (34 TexReg 6831)."
